Chapter 13 - The Family Trust

North Ridge Capital looked independent.

It wasn't.

One holding company owned another.

That company listed a trust.

Trustee:

Diane Mercer.

Beneficiaries:

Ryan and his sister, Melissa.

The plan was uglier than I understood.

Ryan would sell the distressed development land cheaply to North Ridge.

His creditors would get partial payment.

The valuable land would stay inside the Mercer family.

My mother's twelve percent would be bought out at the depressed price.

I would lose leverage.

Diane's trust would gain it.

Then the house equity loan would provide Ryan cash to keep operations alive long enough to complete the transfer.

Rachel looked at the structure.

"It's not genius."

"It feels elaborate."

"Most fraud is paperwork plus confidence."

That sounded familiar.

We notified the other partners.

The sale froze.

Two partners demanded an independent audit.

Within days, Mercer Development's financial problems became impossible to hide.

Ryan blamed me privately.

His text:

You destroyed the company.

I finally replied.

No.

I stopped you from using my property to hide what you did.

Then I blocked him.

That was the only message I sent.

Melissa Mercer called next.

Ryan's younger sister.

We had never been close.

She sounded shaken.

"Sarah, I didn't know about North Ridge."

"Okay."

"Mom made me sign trust papers years ago."

"Then get your own lawyer."

Silence.

"You don't believe me?"

"I believe you need independent advice."

I was done deciding truth based on family roles.

Melissa did hire counsel.

Two days later her attorney contacted prosecutors.

Diane had used Melissa's signature on an amendment too.

Another document.

Another shortcut.

Then Melissa found a locked file box in Diane's garage.

Inside were copies of my driver's license, trust papers, house deed, and a printed photo of my signature enlarged to three different sizes.

There was no misunderstanding left.
