Chapter 14 - THE FIRST HEARING

At the emergency guardianship hearing, Beatrice's lawyer displayed photographs of Clara looking exhausted outside the hospital. He called her grief “instability” and demanded temporary authority over Rosie's care.
Nora stood. “My client called emergency services, accompanied her daughter to the hospital, and followed every medical instruction. The petitioner is not a parent and has provided an affidavit bearing the name of a doctor who hasn't practiced medicine in two years.”
The judge studied the exhibits. “Counsel, where is the author of this affidavit?”
Beatrice's attorney requested additional time. The judge refused to grant guardianship on the evidence presented. Rosie would remain with Clara while the allegations were examined. The judge also ordered relevant records preserved and warned both sides against interfering with witnesses.
Outside the courthouse, Clara bent over, hands on her knees. Relief made her dizzy.
“We won?” Elena asked.
“Today,” Nora answered. “Today mattered.”
Clara hugged Elena. “You shouldn't have to lose your job for telling the truth.”
“I'd rather lose a job than look Rosie in the eye and lie.”
Their relief lasted until Nora checked her phone. Miles had submitted an emergency request in the trust matter, asking the bank to suspend Clara's access to operating funds pending allegations of misconduct. A private bank had already flagged several accounts for review.
“This isn't custody,” Nora said. “It's financial pressure. He wants you broke before the next hearing.”
Clara opened her wallet. The card for Daniel's old joint account was still there, but most of their savings had gone toward estate litigation and the mortgage.
Then a banker called.
“Mrs. Bennett,” he said, “we've discovered a second document authorizing withdrawals from your father's trust. It carries your signature.”

Clara stared at the phone. “I never signed a thing.”
