Chapter 3 - Rachel’s Trust

Lily’s mother, Rachel Carter, had died two years earlier after a long illness.
Before she died, she created a trust for Lily.
Life insurance.
Investment accounts.
A small property portfolio inherited from Rachel’s parents.
His sister Evelyn was backup trustee.
The money belonged to Lily.
Daniel remembered questions now.
Who controls the trust if something happens to you?
Could a guardian approve school expenses?
What if Lily needed residential treatment someday?
He had assumed Vanessa was planning ahead.
“She was studying the structure.”
Daniel looked at the folder again.
“Why?”
Rachel opened the trust document.
“If you were removed as trustee for incapacity or misconduct, control could pass to a court-appointed fiduciary.”
“And Vanessa?”
“If she became Lily’s guardian, she could petition for distributions.”
Daniel’s stomach dropped.
“How much?”
“For legitimate expenses? A lot.”
Vanessa laughed from the doorway.
“This is insane.”
Rachel turned toward her.
“You made a twenty-three-day behavioral file on a four-year-old.”
“I was trying to help.”
“You edited clips.”
“She throws tantrums.”
“She’s four.”
Vanessa’s jaw tightened.
Then Maria remembered something.
“Last week she asked me for Lily’s birth certificate.”
“What?”
Vanessa snapped:
“For preschool.”
“Her preschool already has it.”
Daniel checked the family safe.
Birth certificate missing.
So was Lily’s passport.
“Call the police.”
Vanessa’s face changed.
“You’re overreacting.”
“Where are they?”
“I don’t know.”
“Where are my daughter’s documents?”
Then Lily spoke from the couch.
“Blue bag.”
“What blue bag, baby?”
“Vanessa put Mommy papers in blue bag.”
Daniel looked at Maria.
She ran for the stairs.
Daniel caught Vanessa before she reached the landing.
“Get off me!”
He released her immediately.
“Maria, take Lily to the kitchen.”
Vanessa laughed bitterly.
“Yes, hide her. That’s what you do.”
In Vanessa’s closet, behind three garment bags, sat a blue leather tote.
Inside were Lily’s passport.
TEMPORARY GUARDIANSHIP OF LILY CARTER.
Petitioner:
Vanessa Sterling Carter.
Daniel had never signed anything.
But at the bottom of page six was his signature.
